Risk of loss and title for food items passes to you upon delivery to the delivery address you provide. You must be present at the delivery address to accept the order unless you have made alternative arrangements. Pizza Luce reserves the right to require age verification for orders containing age-restricted items.

7. Allergen and Dietary Information

Pizza Luce makes reasonable efforts to provide accurate allergen and nutritional information on its menu. However, our food products are prepared in kitchens that handle common allergens including but not limited to wheat, gluten, dairy, eggs, nuts, soy, fish, and shellfish. We cannot guarantee that any menu item is completely free from allergens due to the risk of cross-contamination.

• WARRANTIES THAT DEFECTS WILL BE CORRECTED OR THAT THE SITE OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

• Loss of profits, revenue, or anticipated savings.
• Loss of data or information.
• Loss of goodwill or reputation.
• Business interruption.
• Personal injury or property damage arising from your use of our services or products.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, transmitted, or otherwise made available via the Site.

IN NO EVENT SHALL PIZZA LUCE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE OR SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO PIZZA LUCE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you. Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited or excluded under applicable law.

10. Indemnification

You agree to defend, indemnify, and hold harmless Pizza Luce, its parent company, subsidiaries, affiliates, officers, directors, shareholders, employees, contractors, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

YOU AND PIZZA LUCE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both you and Pizza Luce agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

12.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidentiality obligations, or other proprietary rights. Small claims court matters may also be resolved in the appropriate small claims court rather than through arbitration.

12.5 Time Limitation on Claims
